1. Modification of this Agreement

2.1 Eligibility
The Site and Services are intended only for individuals and entities that can form legally binding contracts under applicable law. If you are under the age of 18 (or the applicable age of majority in your jurisdiction), you may use the Site and Services only with the involvement and consent of a parent or legal guardian.

2.2 Compliance with Applicable Law
You agree to use the Site and Services in compliance with this Agreement, all applicable laws, regulations, and any additional policies referenced herein.

3. License to Use the Site and Services

ANS Music grants you a limited, non-exclusive, revocable license to access and use the Site and Services solely for your personal or internal business purposes, subject to your compliance with this Agreement. This license does not include any right to:

Copy, modify, or create derivative works from the Site or its content without our express written consent.
Use any automated systems (e.g., robots, spiders, data mining tools) to access or harvest data from the Site.
Use the Site or Services for any unlawful or unauthorized purpose.
Any violation of these terms may result in the immediate revocation of your license to use the Site and Services.

4. Third-Party Services

The Site may contain links to third-party websites, applications, or services that are not operated or controlled by ANS Music. We do not endorse and are not responsible for the content, privacy policies, or practices of any third-party sites or services. Your use of such third-party services is subject to their respective terms and conditions.

5. Prohibited Uses

Except as expressly permitted in this Agreement, you agree not to:

Interfere with or disrupt the operation or security of the Site or Services.
Introduce viruses, malware, or any other harmful code into the Site.
Collect or harvest any personal data or other information from the Site without prior written permission.
Impersonate any person or entity or misrepresent your affiliation with any person or entity.
Use any meta tags, keywords, or other data that include ANS Music’s name or trademarks in a misleading or unauthorized manner.
Engage in any activity that interferes with another user’s use or enjoyment of the Site and Services.

6. Privacy Policy

By using the Site and Services, you agree to the collection, use, and disclosure of your personal information in accordance with the ANS Music Privacy Policy (which is incorporated herein by reference).

7. Proprietary Rights

All content, trademarks, logos, and other materials on the Site (collectively, “Site Content”) are the exclusive property of ANS Music or its licensors and are protected by copyright, trademark, and other intellectual property laws. You agree not to remove, alter, or obscure any copyright or trademark notices contained in the Site Content.

8. Representations and Warranties

By using the Site and Services, you represent and warrant that:

You have the legal capacity and authority to enter into this Agreement.
Your use of the Site and Services will not infringe on any third-party rights or violate any applicable laws.
Any content you provide to ANS Music does not contain viruses or other harmful components.

9. Indemnification

You agree to indemnify, defend, and hold harmless ANS Music, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site and Services or your breach of this Agreement.

10. Disclaimer and Limitation of Liability

Disclaimer of Warranties
THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. ANS MUSIC DOES NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability
IN NO EVENT SHALL ANS MUSIC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR SERVICES. ANS MUSIC’S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (i) THE AMOUNT PAID BY YOU (IF ANY) FOR ACCESSING THE SITE OR SERVICES DURING THE SIX (6) MONTH PERIOD PRIOR TO THE CLAIM, OR (ii) $100.

11. Termination

ANS Music reserves the right to suspend or terminate your access to the Site and Services, in whole or in part, at any time and without notice if you violate this Agreement or for any other reason at our sole discretion. Sections 4, 5, 7, 8, 9, 10, and 12 of this Agreement shall survive termination.

12. Dispute Resolution

Any disputes arising out of or relating to this Agreement or your use of the Site and Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. You and ANS Music agree to waive any right to a trial by jury or to participate in a class action. The arbitration shall be conducted in English and in the jurisdiction where ANS Music is located, unless otherwise mutually agreed upon in writing.

13. Copyright Infringement Claims

ANS Music respects the intellectual property rights of others. If you believe that your copyright or other intellectual property rights have been infringed by content on the Site, you must provide a written notice containing:

Your name, address, telephone number, and email address;
A description of the copyrighted work claimed to have been infringed;
A description of the material that is claimed to be infringing and the location of the material on the Site;
A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner; and
Your electronic or physical signature.

All notices required or permitted under this Agreement must be in writing and delivered via email or postal mail. Notices to ANS Music should be addressed to:

15. Miscellaneous

This Agreement constitutes the entire agreement between you and ANS Music regarding your use of the Site and Services and supersedes all prior agreements, understandings, or representations. If any provision of this Agreement is deemed unenforceable, the remaining provisions shall continue in full force and effect. No waiver of any term of this Agreement shall be considered a further or continuing waiver of such term or any other term. This Agreement is governed by and construed in accordance with the laws of the jurisdiction in which ANS Music is primarily operated, without regard to its conflict of law principles.
